I have 5 days after my due date to turn in my payment for the loan I took out. My payment was due the 15th and today is the 19th. I dropped off a check yesterday the 18th and dated it for today because i was getting paid and then i would have enough in my account for them to take it out. But no they decided to go ahead and cash it out on the 18th which now i have to pay the overlimit fee with Bank of AMerica and pay stupid american general fiance a fee because my check bounced! are they stupid or not... when someone dates the check for a certain date that basically means dont cash it untill then!!!!

Bad business practice. I've had something similar happen, but it was taken care of by my bank. I was lucky enough to have an account at a bank where the employees not only check the signature, account numbers, and amount, but also the date on the check. Posting dating is not illegal, in fact, some banks encourage it so that a person can get a payment mailed to a company on time, but the funds are not withdrawn until the date where it can clear. Know your law Harley, it's on the internet, and also located in these old buildings that are secretive and full of knowledge, they are called libraries.

Where I live it is not illegal, but also, when they actually post it on the day you drop it off, their bank doesnt get it until that night, and in turn, your bank doesnt get it until a business day or two after. Unless you bank on the same day, then usually it doesnt hit your bank until the next day anyway. I know how this works as I work at a bank

Its not illegal to post-date a check in the state I live in, but it is illegal for them to deposit the check before the date on the check
