| 1. Written by loan dice, on 13-04-2009 21:33 Well first off its your signature on the loan, if you didnt like the terms you should not have closed. 2nd if they worked with you so well before then why do you wanna take them to court? You spent your money on a lawyer and some joke of a company from New Jersey, well it seems like you should been paying your mtg. I even bet while you were consulting your attorney and that joke of a company from NJ you stopped talking to American General. Get off your A$$ and pay . You just want a free ride, lower my rate, you should just ask them to extend your term, if your hurting that bad. |

Written by , on 13-04-2009 09:18 The letter I wrote below has been sent by e-mail to President Obama and Congress, the Ohio Congress man, around 12 mediators and will also be sent to the Attorney Generals office. I agree with other people that this company should be shut down and someone take over the mortgage loans that will work with people to help them keep their homes. _________________________________________________ April 9, 2009 To Whom It May Concern; The issue I am writing about may not be of great importance to you but it is of great importance to my family and myself. I am sure you have received many letters from people having problems making mortgage payments and needing financial help. Well I am not asking for money only a little help with talking to our mortgage company and getting them to modify our home interest rate of 12% and our mortgage payment of $1400+ a month. We obtained a mortgage from; American General Finance Service 904 South Hamilton Road Columbus, Ohio 43213 Phone # 1-614-861-5369 - you can talk to Aaron or Nichol This mortgage was obtained in 2003 for a total of $110,000.00 and now 6 years later and many payments made to them we owe $118,000.00+. Four people were signed on this loan with all of them having an income at the time it was taken out. My mother was the main signer and because she was on a fixed social security disability income our interest rate was and still is 12%. Also signed on the loan was (myself), my oldest son and my youngest son. We all lived in this house. I will not say we are not like everyone else after all one of our family members has lost his job around Thanksgiving but is receiving unemployment at this time. He receives $600 a month. I myself was injured on my job Dec. 26, 2008. I was an over the road truck driver. I sprained my back and have been unable to work and under a doctor’s care since the end of Dec., 2008. I had applied for workman comp but the company appealed it. I had to go to a hearing on April 3, 2009 and was approved. I have not received any money from Dec., 2008 until now. I am waiting to hear from the lawyer so I can pick up my check which pays me from Jan.1st to April 3rd. Rough figure - after the lawyer takes his money I should have between $3000 and $4000 coming in a lump sum check. I will also receive workman comp until the doctor releases me. Also I have applied for early retirement and have been approved. As of the beginning of June I will be receiving approximately $550 a month but will also be able to work and make $14000 extra for the year without it affecting my social security monthly amount. My youngest son works for RAC rent-a-center in Greenville, Ohio. He has been there for a long time. He brings home around $350 to $380 a week. My mother also helped to pay on the mortgage each month but she passed away Jan. 27, 2009. So you see we have money coming but with the lose of a family member not enough to make a $1400+ mortgage payment each month. I have talked to the mortgage company often and they know everything that has happened to us over the years and recently. We refinanced with them several years after my father passed away. We had small loans with them and had no problems and when they went into mortgages we decided to go with them. I have regretted this many times over the years. First the two people who drew our mortgage paperwork up were gone two weeks later. Then I dealt with a guy named Brad. I called him because I was short on the mortgage payment and asked him if I could pay him what I had and make up the rest later. I was told they wouldn’t take less then a full payment. He told me to write two checks, one I knew would clear and one I knew would bounce and than he could take them. I found out later that this was not true and they would have taken a lesser payment. I had to do this a few time and they nailed me royally with NSF charges which are still showing up on our payment receipts. Later I called and talked to him about something and then called back the next day. I spoke to a Cory the very next day and he told me that Brad no longer worked for the company and as far as he knew Brad was in jail. We made our payments to there office near us in Ohio and they closed it Oct. 2008. Most of the people I have talked to in the passed six years are gone. Some of them in just a few weeks. I talked to a Josh about three years ago when we got behind because of a change of jobs. We found out what we needed to catch it up and got the money together by working extra hard. I called Josh and told him I that one of the family would be in on Friday to make the payment. He said he wouldn’t do anything until we came in. We paid it Friday and received foreclosure papers Saturday. I called and they said they would stop the foreclosure but it took over a week to get it taken off of the courthouse computer system and in the mean time we had real estate people calling us and showing up wanting to buy the house. My mother was not in the best of health then and the stress and worry from this took a toll on her. Shortly after this Josh was gone. Back in 2005 my mother wanted her name removed from the house. It was in her and my oldest sons names. Her name was removed through the courts and my youngest sons name put on. We asked American General since my mothers name was removed from the title on the house could we get the house refinanced and her name removed from the loan. Hoping that since my two sons which at the time were 32 and 26 years of age and both working could get a lower interest rate and possibly a lower payment. They refused to refinance the loan. Mom was still paying on it but didn’t want to be on any paperwork including the loan. This would have put her mind at ease but since she was still on the loan she worried about losing the house all the time. By the way my mother died from a massive heart attack. She was always stressed out over what we were going through. I have asked American General several times to modify our loan and reduce our interest rate and payment and they have always refused. They either said they would not do it because we were getting behind or because we did not have our own house insurance. With the payment we have it is a little hard to keep the place up enough to get house insurance. I have called at less a dozen places and they won’t touch us. They want us to put a new roof on it, reside it, put a new furnace in, redo the electric and plumbing and fix all the outside buildings. We could do that if we hadn’t had such a large mortgage payment. Besides we were just trying to get insurance on what we have not build a new house. American General is charging us over $100 a month for just enough insurance to cover the loan. A couple of years ago I talked to them again. They made payment arrangements with us. They said we could pay $900 a month for 6 months and then they would raise it to $1100 since things should be a little better for us by then. We never missed a payment until mom died. I really thought this was nice of them to work with us like that until lately. I just found out recently that they were still figure we had a $1400+ payment a month and every time we paid $900 or $1100 a month we were falling hundreds of dollars behind. I never knew this is what they were doing until after mom died and I talked to them. I would never have accepted payment arrangements like this if I had known what they were going to do. No one in there right mind would have. Because of this we are thousands of dollars behind instead of only missing the last 3 months of payments which could be caught up when I receive my check from workman comp. They did say they would modify the loan but get this, we were having a hard time making an $1100 payment and they wanted to set the payment modification to read $1100 a month with an additional $100 a month for insurance. Well if you can't make a $1100 a month payment how in the heck do they expect you to make a $1200 one. When someone asked me how many months we are behind I can’t answer that question because I don’t know. They also said that if we made the arranged payments for one year and didn’t miss any they would see about refinancing our home. When the time came for this they refused. Now they refuse to modify our loan and have foreclosed on us. They said they would stop foreclosure if we pay up the passed due amount but they never said if they are talking about just the last 3 months or everything. The lawyer that is working for them sent us a letter and we have to answer it in the next two weeks. He stated that they want the full amount of $118,000.00+ paid in full. We have money coming in like I said and if the interest rate and payment could be lowered down to $700 or $800 or at least a amount with in our budget we could keep the payments up and stay in the house and keep it maintained. It has lost a lot of value and they wouldn’t get much out of it. They would have a lot of fixing up to do on it. If it stands empty for any length of time it will probably fall down since it is an old farm house over 100 years old. My oldest son is doing a lot of the work on it but it takes time and money. We are more then willing to keep working on it and maintain it after all there are a lot of memories here for us. Both my parents passed away here, my oldest son was raised here from the age of 4 and my youngest son was born here. It seems stupid to me to want to put us out when if they would just lower the payment to something reasonable we could keep making payments on it. So you see I DON’T WANT ANY MONEY just someone to take a few minutes of there time and help us with this issue. Someone with pull who could make American General work with us so we can stay in our home. All of us have lived here, my parents, both my boys and I. We have always been a real close family. My parents are both gone now and if we have to move out of our house my youngest son won’t leave here because his dad is 70 years old and living in close by here in Ohio and he checks on him at least once a week. My oldest son and I will move out of Ohio. This is going to break up what is left of our family. I have talked to a lawyer but of course they are very expensive and I got involved with New Hope Modification out of New Jersey back in January and I found out recently that they are a fraud and just take your money. So now I have to try and get that money back. Legal Aid says their over whelmed and don’t know if they would have a lawyer that could help us. I even wrote to President Obama last week but I didn’t expect I would hear from anyone and haven’t so far but I still have hope. If you can help us in anyway please, please do so. Even if American General got bombarded with phone calls from people in high offices maybe they would work something out with us. Please help in anyway you can. Sincerely, P.S. Anyone who is working on investigating American General Finance or wanting to get a hold of me to get together and get a lawyer to go up against American General Finance please contact me at my e-mail address. |
